This privacy policy describes the current policies and practices of Superfly Festivals New York, LLC (“Company”) with regard to personal data collected by Company through its website Googamooga.com and personal data associated with the purchase or registration of a ticket to The Great Googa Mooga Festival (“Googamooga”) through the Eventbrite.com website, the official ticket company for the Googamooga (the “Sites”). This privacy policy is independent from Company’s offline personal data collection practices.

Company collects two basic types of information through the Sites, personal data and anonymous data. The term “personal data” refers to personally identifiable information about you, such as your name, birth date, credit card number, e-mail address or mailing address, and any other information that is identified with you personally, including your individual health information. The term “anonymous data” refers to data that does not reveal your specific identity, such as geographical location, demographic data or other statistical information.

Notification of Changes to This Policy.

Company is continually improving and adding new functionality and features to its websites and improving and adding to our existing products, services, and programs. Because of these ongoing changes, changes in the law and the changing nature of technology, Company’s data practices will change from time to time. If and when our data practices change, Company will post the changes on Company’s websites to notify you of the changes and if the changes are significant, we will provide a more prominent notice. By using the Sites, you are accepting the practices we describe here. If at any time you do not accept all the terms and conditions contained herein, you must immediately discontinue use of the Sites.

Personal Data Collected 

Other than cookies, as described below, the only personal data Company currently collects through the Sites is the information you voluntarily give us when you use the Sites.

For example, you may use the Sites to contact Company with questions and comments. When you fill out a form on the Sites, which may include questionnaires in connection with registering your name for possible receipt of free tickets to the Googamooga, you may provide your name and other contact information, including your company’s name, your e-mail address, and your mailing address or the mailing address of your company or other personal information. If you do not wish to fill out all of the information on the form you are not required to do so. Most of our registration forms require only your name and e-mail address. When you submit information to us through the Sites, you will receive a confirmation e-mail if you enter a valid e-mail address. When you use our websites to search for information about our festival, you are not providing us with any personal information. We offer the search features as a service to you. Company does not collect or retain any personal identifying information about you when you use the search features.

Personal Data Collected Through Registering for Free General Admission Tickets or the Purchase of Extra Mooga Tickets.

When a ticket order is placed with Eventbrite.com, Company collects certain data during the order process. By voluntarily registering or purchasing a ticket to the Googamooga, you will be required to provide us with the information necessary to process your ticket order, such as name, address, credit card number, and other information required by Eventbrite. Company does not own or control Eventbrite.com. By using Eventbrite.com you will also be subject to their customary terms of use; accordingly, please familiarize yourself with the Eventbrite.com Terms of Service Agreement, available at http://www.eventbrite.com/tos, and the Eventbrite Privacy Policy, available at http://www.eventbrite.com/privacypolicy.

 

Use of Personal Data Collected .

Company uses the personal data information you provide to answer your question or resolve your problem, to contact you with information about your order, if applicable, or the Googamooga. Company and our affiliates also use this information to help us improve the content and functionality of our websites and festival operations, to better understand our customers and markets, and to improve our products and services. Company and our affiliates may use this information to contact you in the future to tell you about products or services we believe will be of interest to you. If we do so, each communication we send you will contain instructions permitting you to “unsubscribe’ from receiving future communications.

Similarly, we may provide “subscription” e-mail services, either directly or through affiliates, which enable you to receive current news and updates about the Googamooga or Company. For all such services, we will provide an opportunity to “unsubscribe” from, or cancel, the subscription. In the event you unsubscribe from receiving any future communications, Company reserves the right to contact you in the event of a change in the websites terms and/or this privacy policy or to notify you of other administrative matters in connection with the Sitea (e.g to facilitate a transaction).

Anonymous Data Collected

In addition to the information you provide when you use the Sites, Company uses technology to collect anonymous information about the use of the Sites. For example, we use technology to track how many visitors access the Sites, the date and time of their visit, the length of their stay, and which pages they viewed. We also use technology to determine which web browsers our visitors use and the address from which they accessed the Sites (for example, if they connected to a Company website by clicking on one of our banner ads).

This technology does not identify you personally. It simply enables us to compile statistics about our visitors and their use of our sites. Company and our affiliates use this anonymous data and share it with third parties to improve the content and functionality of our websites, to better understand our customers and markets, and to improve our products and services.

Cookies.

A cookie is a small piece of information that is sent to your browser and stored on your computer’s hard drive. IP Addresses and Click-stream Data

We may collect IP addresses and/or click-stream data for purposes of system administration and to report aggregate information to our advertisers and sponsors.

An IP address is a number that is automatically assigned to your computer whenever you access the Internet. Our computers identify your computer by its IP address. When you request web pages from the Sites, our computers log your IP address. We use your IP address to help diagnose problems with our server, and to administer our Web site. Your IP address is also used to gather broad demographic information. We may also link your IP address to personally identifiable information for fraud prevention purposes.

Click-stream data is information collected by our computers when you request Web pages from the Sites. Click-stream data may include such information as the page served, the time, the source of the request, the type of browser making the request, the preceding page view and other such non-personal information. When analyzed, this data helps us analyze how visitors arrive at the website what type of content is most popular, what type of visitors in the aggregate are interested in particular kinds of content and advertising, and the like.

Company may share some or all of the personal data collected through the Sites with Company’s affiliates, who use this data in accordance with this Privacy Policy.

Both Company and our affiliates may share personal data collected through the Sites with third-party vendors who act for or on behalf of Company or our affiliates (for example, companies that provide support services to us, including data processing services, or that help us market our products and services). This site may make chat rooms, forums, message boards, and/or news groups available to its users. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information.

Children

Company strongly encourages parents and guardians to supervise their children’s online activities and to consider using parental control tools available from online services and software manufacturers to help provide a child-friendly online environment. These tools also can prevent children from disclosing online their name, address, and other personally identifiable information without parental permission. Tickets and products for sale are intended for purchase by adults. By making a purchase on the site, you agree that you are at least 13 years of age. Although the Sites are not directed to children under the age of 13, Company does not knowingly collect personal data from children under the age of thirteen. If you are under thirteen, please do not give us any personal data. If you have reason to believe that a child has provided personal data to Company, please contact us, and we will try to delete that information from our databases.

This privacy policy applies only to the Sites. Company and our affiliates operate other websites for different purposes and in different countries where different laws may apply. If you visit a Company or third party website, including the Eventbrite.com website, please take a moment to review the privacy policy posted on that site to learn what personal data may be collected through that site and how it is processed.

The Sites contain hyperlinks to websites that are not operated by Company or one of our affiliates. These hyperlinks are provided for your reference and convenience only and do not imply any endorsement of the activities of these third-party websites or any association with their operators. Governing Law

This privacy policy forms part of our website Terms and Conditions and as such shall be governed by and construed in accordance with the laws of the State of New York.  Company makes no representation that the Site are governed by or operated in accordance with the laws of other states or nations, or that the Sites or any part thereof is appropriate or available for use in any particular jurisdiction. Those who choose to access the Sites do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules and regulations.  Without limiting the foregoing, by using this site, visitors from outside of the United States of America acknowledge that they waive any claims that may arise under their own national laws.

RFID Card Privacy Policy

When you purchase a cashless card for the 2012 Great GoogaMooga Festival (the “Card”), we will collect certain data to facilitate and/or execute the order. Purchasers will be asked to provide an email address to associate with the Card, though providing such information is strictly voluntary. The Cards contain radio frequency identification (RFID) chips that track what the Card owner purchases. The RFID technology also allows us to collect anonymous information about the users, such as tracking general purchasing habits allowing us to compile general statistics about our visitors, but does not identify the user personally.

We may use this information to help us to better understand our customers and markets and to improve our products and services. If you provide your email address, we may also use this information to contact you about products or services we believe will be of interest to you. If we do so, each communication we send will contain instructions permitting you to “unsubscribe” from receiving future communications.
